Terms of Use

The house rules for CrewPlay: what you can expect from us, and what we ask of you. By installing or using CrewPlay you agree to them, so please give them a read. The short version below is a friendly summary, and the numbered clauses are the actual terms.

The short version

  • CrewPlay is yours to play. A personal licence to use it on your devices: at home, with friends, in class, wherever the fun is.
  • Play fair and be kind. No cheating in other people’s Crew Link games, no messing with anybody’s phone, and no nasty names.
  • Coins are for fun. You earn them by playing. They have no cash value, can’t be bought or sold, and live only on your phone.
  • Purchases are one-time, through Google Play. Nothing renews. Refunds follow our Refund Policy, and your legal rights always apply.
  • CrewPlay keeps changing. Games and features will come and go. If we take away something you paid for, we’ll put it right.
  • Indian law applies, and nothing here takes away rights your own consumer law gives you.

1 About these terms

These terms are an agreement between you and Epsilon Developers about using CrewPlay. Our Privacy Policy and Refund Policy are part of them.

  1. These Terms of Use (“Terms”) are a legal agreement between you and Epsilon Developers (“we”, “us”, “our”), based in India, about your use of the CrewPlay app for Android, its games and features including Crew Link, and this website (together, “CrewPlay”).
  2. By downloading, installing, opening or using CrewPlay you agree to these Terms. If you do not agree, please do not use CrewPlay; you can uninstall it at any time.
  3. Our Privacy Policy, Refund Policy and the other policies in our Legal Centre form part of these Terms. If they conflict, these Terms apply, except that the Refund Policy applies to refunds.
  4. You get CrewPlay from Google Play, so the Google Play Terms of Service also apply to downloading it and to paying for purchases. Google is not responsible for CrewPlay itself; we are.
  5. Nothing in these Terms takes away any right you have under consumer protection law that cannot be changed by a contract (“your statutory rights”).

2 Who can use CrewPlay

Anyone can play. If you are under 18, a parent or guardian agrees to these terms for you and looks after purchases.

  1. You may accept these Terms if you are 18 or older, or the age of majority where you live if that is different, and able to enter into a binding contract.
  2. If you are younger, your parent or legal guardian must read and accept these Terms for you, is responsible for how you use CrewPlay, and must make or approve any purchase. Children are very welcome to play. CrewPlay is a family party game, played under that adult’s care.
  3. Purchases are made by the holder of the Google Account on the device. If you let others use your device, you are responsible for purchases made on it. Google Play can ask for a password or fingerprint before every purchase; see Children & Families.

3 Your licence to play

You may install CrewPlay and play it for fun on devices you own or control, and stream or share your games. You may not copy, resell or rebuild the app.

  1. We give you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download, install and use CrewPlay on Android devices you own or control, for personal, non-commercial entertainment, including playing with other people on your device and through Crew Link.
  2. Playing CrewPlay with family and friends, at parties, in classrooms, clubs and community groups is exactly what it is for, as long as nobody is charged to play it. Please ask us first before using CrewPlay at a paid or ticketed event, or as part of a commercial service.
  3. You may record, stream and share videos and screenshots of your games, including on channels that earn money, as long as you do not suggest that we endorse you or your content, and you do not share our artwork or sounds separately from gameplay.
  4. CrewPlay is licensed to you, not sold. We and our licensors keep every right that these Terms do not expressly give you.

4 House rules

Play fair, be kind, and don’t try to break CrewPlay or anybody else’s phone.

  1. When you use CrewPlay you agree not to:
    1. copy, modify, distribute, sell, rent, lend or sublicense CrewPlay or any part of it;
    2. decompile, reverse engineer or disassemble CrewPlay, except where the law allows it regardless of this rule;
    3. unlock paid content without paying, or interfere with how purchases are checked;
    4. use cheats, bots, automation or a modified version of CrewPlay in a Crew Link match with other people, or send another player’s phone anything that is not normal play;
    5. try to access, disrupt or harm any device, network or Crew Link room you are not entitled to use, including other people’s rooms on a shared network;
    6. use a player name that is offensive, hateful, sexual or harassing, that pretends to be somebody else, or that reveals another person’s private information;
    7. use CrewPlay for anything unlawful, or in a way that breaks the rules of a network you are on;
    8. remove or change any copyright, trademark or other notice in CrewPlay.
  2. Good-faith security research that follows our Security & Disclosure policy does not break these house rules.

6 Names and what you share

You choose players’ names and what you share. Keep names friendly, and share only what you want to.

  1. Player names are nicknames that you create and keep on your device. Please do not use somebody else’s full name, contact details or other personal information without their permission.
  2. When you share a score card, a result or your exported stats, you choose where it goes, and you are responsible for sharing it lawfully. We do not receive or publish anything you share.
  3. Anything you send to us, such as feedback, bug reports or ideas, is covered by section 14.

7 Coins and in-game items

Coins are earned by playing and spent on fun extras. They have no cash value, can’t be bought, sold or moved, and live only on your phone.

  1. CrewPlay’s coins, and anything you unlock with them such as characters or themes, are an in-game feature that we license to you. They are not money, have no cash or real-world value, and can never be exchanged for cash, goods or anything outside CrewPlay.
  2. Coins cannot be bought. You earn them by playing and through features such as the daily free spin. They cannot be sold, traded, or transferred to another player or device.
  3. Coins and coin unlocks are stored only on your device. They are lost if you reset CrewPlay, clear its storage or uninstall it, unless Android restores them from your own backup. We cannot recover them, because we never have a copy.
  4. We may change how coins are earned, or what things cost in coins, to keep the games fun and fair.

8 Purchases

Everything you can buy is a one-time Google Play purchase: nothing renews and nothing expires. Prices come from Google Play, in your own currency.

  1. CrewPlay may offer one-time digital purchases (“Purchases”). They are processed by Google Play under Google Play’s terms, and we never see your payment details.
  2. Google Play shows the price in your local currency when you buy, including the taxes Google Play collects where they apply. Prices of future Purchases may change, and we do not refund the difference if a price later falls or goes on sale.
  3. Purchases do not renew: there is no subscription and nothing to cancel. A Purchase is a licence to use the feature it unlocks, for as long as described in clause 8.6. It has no cash value and cannot be transferred or resold.
  4. A Purchase belongs to the Google Account that made it. On a new or reset phone, sign in with the same Google Account and use Shop → Restore purchases.
  5. If Google Play shows a payment as pending, the Purchase unlocks once Google confirms it. If a payment is never completed, Google Play cancels the order and returns your money automatically, usually within three days.
  6. “Lifetime”, “for ever” and “for good” mean for as long as we offer CrewPlay and it runs on your device. CrewPlay runs entirely on your phone, so a copy you have installed keeps working even if CrewPlay is later withdrawn from Google Play.

9 CrewPlay Premium and game unlocks

Premium is one payment that keeps CrewPlay ad-free and opens every game. It is not on sale at the moment, because CrewPlay has no ads and every game is free. If you already own it, it stays yours.

  1. CrewPlay Premium is a one-time Purchase. It gives the Google Account that owns it:
    1. CrewPlay without advertising, on any device where you use that account, including if we introduce advertising in the future; and
    2. every game we mark as premium, now or in the future.
  2. Not on sale at the moment. CrewPlay currently shows no advertising to anybody, and every game is free to play, so there is nothing Premium would add. We have stopped selling it until that changes, and we will update these Terms before it goes on sale again. If you already own Premium, it stays yours on every device where you use that Google Account, and Shop → Restore purchases brings it back.
  3. Game unlocks. We may offer a one-time Purchase that opens premium games without removing advertising. We only offer it while there are premium games to open, and the Shop says what it includes.
  4. In a Crew Link room, the host’s Purchases apply to the whole room (clause 5.2). Premium’s freedom from advertising applies only to the devices of the person who bought it.

10 Refunds and cancellation

Ask Google Play within 48 hours, or ask us at any time if something is wrong. The Refund Policy has every detail.

  1. Refunds are covered by our Refund Policy, which is part of these Terms. In short: Google Play handles refund requests made within 48 hours of purchase; after that, contact us and we will help, and we always refund a Purchase that does not work, was not delivered, or is not as we described it.
  2. There is nothing to cancel, because no Purchase renews.
  3. If you live in the EEA or the UK, you may have a right to withdraw from a digital purchase within 14 days. Google Play asks you, when you buy, to agree that the content is supplied straight away and that you then lose that right. This does not affect your other rights, including your rights if the content is faulty.

11 Changes to CrewPlay

CrewPlay keeps improving, so things will change. If a change takes away something you paid for, you can have your money back.

  1. We may update CrewPlay, adding, changing or removing games, features and content, to improve it, keep it secure or comply with the law. Some changes need an update from Google Play.
  2. Games marked “Soon” are previews of what we are working on, not promises. They cannot be bought or played until they are released.
  3. If an update takes away a game or feature that a Purchase gave you, and we do not replace it with something similar, you can ask for a refund of that Purchase under our Refund Policy. Your statutory rights also apply.
  4. We may stop offering CrewPlay on Google Play. If we do, the copy on your phone keeps working (clause 8.6), but updates, Crew Link with newer versions, and restoring Purchases on new phones may stop being possible.

12 Other companies’ services

Google Play, the Daily Challenge word service and the apps you share to have their own terms. We are not responsible for them.

  1. CrewPlay relies on services we do not control: Google Play for downloads, purchases and updates; the free word service behind the Daily Challenge; your network provider; and any app you share to. Their own terms and privacy policies apply to them, and we are not responsible for their availability or what they do.
  2. If the word service is not available, the Daily Challenge uses a word built into CrewPlay, so it always works.

13 Our intellectual property

CrewPlay, its games, characters, art, sounds and name belong to us. Open-source parts come with their own licences.

  1. CrewPlay, including its code, its games as we have built them, its characters (including Aria, Kai, Rex and Luna), artwork, sounds, text, logos and the CrewPlay name, belongs to Epsilon Developers or its licensors and is protected by intellectual property law. These Terms do not let you use our name, logos or characters except as part of using CrewPlay and as clause 3.3 allows.
  2. Traditional games such as Ludo, carrom, kabaddi and tic-tac-toe belong to everybody. Our versions of them, and the way they look and play in CrewPlay, are ours.
  3. CrewPlay includes open-source software and the Nunito typeface (SIL Open Font License 1.1), each under its own licence. You can read those licences in the app under Settings → About → Open-source licences. Where an open-source licence gives you rights over a component that these Terms would otherwise restrict, the open-source licence applies to that component.

14 Feedback and ideas

We love hearing ideas. If you send us one, we may use it without owing you anything.

  1. If you send us feedback, suggestions or ideas, you allow us to use them freely, without payment or credit, to improve CrewPlay and our other products. Please do not send us anything confidential, or anything that belongs to somebody else.

15 Play safely

CrewPlay is a hands-on, shared-screen game. Hold on to the phone, mind your surroundings, and take breaks.

  1. Photosensitivity. A very small number of people may have seizures when exposed to flashing lights or patterns, including in games. If you, or anybody in your family, have epilepsy or have ever had a seizure, talk to a doctor before playing. Stop straight away if anyone feels dizzy, or notices changes in vision, twitching, disorientation or any involuntary movement.
  2. Sharing one phone. Several people touching one phone can knock it over. Put it on a flat, stable surface, keep drinks away, and keep an eye on young children.
  3. Take breaks. Rest your eyes and hands regularly, especially in long sessions.
  4. Only play where it is safe: never while driving or cycling, crossing a road, or anywhere you need your attention.

16 Disclaimers

We work hard to make CrewPlay great, but it comes as it is. Your statutory rights still apply in full.

  1. We provide CrewPlay with reasonable care and skill. Beyond that, and as far as the law allows, CrewPlay is provided “as is” and “as available”, and we do not promise that it will be uninterrupted or error-free, that it will work on every device or network, or that any particular game or feature will always be available.
  2. Nothing in these Terms excludes or limits any warranty, guarantee or right that the law says cannot be excluded, including under India’s Consumer Protection Act, 2019, the consumer laws of the EEA and the UK, and the Australian Consumer Law.

17 Limitation of liability

If something goes wrong, our liability is limited as far as the law allows, but never where the law says it can’t be.

  1. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
  2. Subject to clause 17.1, and as far as the law allows, we are not liable for: (a) indirect or consequential loss, or loss that was not reasonably foreseeable; (b) lost progress, coins or other information stored on your device, of which we never have a copy; (c) network, data or device charges; or (d) problems caused by your device, your network or services we do not control.
  3. Subject to clause 17.1, and as far as the law allows, our total liability to you for all claims about CrewPlay is limited to the greater of (a) the total you paid for Purchases in the 12 months before the event that led to the claim, and (b) ₹1,000 (one thousand Indian rupees).
  4. If you are a consumer in the EEA or the UK, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses: CrewPlay is for personal use.

18 Ending these terms

You can stop at any time by uninstalling. If somebody seriously breaks the house rules, their licence ends.

  1. You can end these Terms at any time by uninstalling CrewPlay. Your Purchases stay with your Google Account if you come back.
  2. If you seriously or repeatedly break these Terms, your licence to use CrewPlay ends automatically, and we may decline to support you or to sell you further Purchases. CrewPlay has no accounts or servers, so we cannot, and will not, reach into your phone to switch it off.
  3. Clauses that by their nature should last after these Terms end continue to apply, including clauses 7.1, 13, 16, 17, 20 and 21.

19 Changes to these terms

If we change these terms we publish the new version here, and we tell you about important changes before they apply.

  1. We may update these Terms to reflect changes to CrewPlay, to the law, or to how we work. The date at the top shows the last change, and the history below lists what changed.
  2. For significant changes that are not in your favour, we give at least 30 days’ notice on this website and, where we can, in the app, before they apply, unless a change is needed sooner for legal or security reasons. If you keep using CrewPlay after a change applies, you accept it. If you do not accept it, please stop using CrewPlay; our Refund Policy covers any recent Purchase.
  3. A change never applies backwards to a Purchase you made before it took effect in a way that reduces what you paid for.

20 Governing law and disputes

Indian law applies. Talk to us first, because most things are sorted by one email. You can always use your local consumer bodies and courts.

  1. These Terms are governed by the laws of India.
  2. If something is wrong, please contact us first (section 22). We acknowledge a complaint within 48 hours and aim to resolve it within 30 days.
  3. Subject to clause 20.4, the courts of India have jurisdiction over any dispute about these Terms or CrewPlay.
  4. If you are a consumer, you may also bring a complaint before the consumer commission or courts where you live, and use your country’s consumer protection services. In India these include the National Consumer Helpline (call 1915, or visit consumerhelpline.gov.in) and e-Daakhil for online complaints. If you live in the EEA or the UK, you benefit from the mandatory consumer protections of the country where you live, and can bring proceedings there.

21 General

The usual small print that keeps the rest working.

  1. These Terms, with the policies they include, are the whole agreement between you and us about CrewPlay.
  2. If a court finds any part of these Terms unenforceable, the rest stays in effect.
  3. If we do not enforce a right straight away, we can still enforce it later.
  4. We may transfer our rights and duties under these Terms to another organisation, for example if CrewPlay is sold, and that will not reduce your rights. You may not transfer your rights under these Terms to anybody else.
  5. We are not responsible for delays or failures caused by events outside our reasonable control.
  6. These Terms are written in English. If we provide a translation and the two differ, the English version applies, unless local law says otherwise.
  7. Nobody other than you and us has any right to enforce these Terms.
